How to Get a Publication Divorce in Georgia
- 1). Go to the courthouse and pick up the contested divorce packet from the court clerk. This packet will tell you what information is needed from you to grant you a divorce.
- 2). Sign a sworn affidavit stating that you do not know where your spouse resides and that you honestly tried (with proof, such as returned certified mail to her last known address, or statements from a private detective) to find her current location. On the affidavit you must provide the last known address of your spouse.
- 3). File a motion to serve the defendant, your spouse, by notice of publication in the newspaper. This will need to be submitted with your affidavit of sworn statement.
- 4). Run your newspaper ad for four consecutive weeks once the judge grants your motion. If your spouse does not file an answer, you can be granted a divorce 60 days from the time of the first day of your newspaper ad, but you will have to attend a court hearing before you will be granted the divorce.
