Forms Needed to Petition an Illegal Wife
- As a legal citizen of the United States, you can help your illegal wife become a permanent resident by petitioning for a green card through the United States Department of Homeland Security Citizenship and Immigration Service. You must correctly complete specific forms to petition for an alien relative to be granted a visa to reside legally in the U.S.
- Form I-130 is used to petition for an alien relative, including the spouse of a U.S. citizen. Five pages of instructions must be followed completely to process the form. The two-page form requires detailed information on both the legal U.S. husband and the illegal wife. Form I-130 must be submitted with attached identification documents and fees. Once the Form I-130 is filed and approved, subsequent steps must be taken before a green card is granted.
- Form I-485 is the application to register permanent residence or to adjust status to a permanent U.S. resident. Form I-485 is filed once the government approves a Form I-130 petition. Form I-485 is a four-page application with 11 pages of instructions. A separate fee must be submitted.
- Form G-325A must be completed and submitted, along with Form 1-130, as proof of a legal marriage between the spouses. Form G-325A requires detailed information on spouses, including family history and address and employment history. There is no filing fee.
- Form I-134 is an affidavit of support form in which the legal citizen guarantees he will be financially responsible for the immigrant and they will not rely on public care while awaiting permanent citizenship. The legal resident must provide employment information, annual income, and values of stocks, bonds, savings, life insurance, real estate and any other equity. The sponsor must also list any individuals who are partially or completely dependent upon them for support. There is no fee for filing Form I-134.
