How to File an EEOC Complaint in Ohio
- 1). Complete and file the EEOC complaint in a timely fashion as the commission requires that you file the complaint within 180 days of the first discriminatory act. Skip the EEOC complaint process and file a suit directly with the court if your complaint involves discrimination under the Equal Pay Act. File this claim within two years of the first discriminatory paycheck.
- 2). Contact an EEO counselor within 45 days of the discriminatory act if you are a federal employee or applicant. Follow the federal guidelines as outlined by your EEO counselor to file your federal claim of discrimination.
- 3). File a Charge of Discrimination complaint with the EEOC if you are a non-federal employee. Complete the online assessment at the EEOC's website to determine if the EEOC complaint is the correct process for your situation. Complete the Intake Questionnaire if the assessment tool shows that the EEOC can assist you. You can complete and submit the Intake Questionnaire if you are unsure of the assessment's findings or you want the EEOC to review your information anyway.
- 4). Mail your Intake Questionnaire to the EEOC or submit your application personally to the local EEOC office. Use one of Ohio's two EEOC offices located in Cleveland and Cincinnati. Be sure that the application includes accurate details and contact information and remember to sign and date the charge. You can also contact the EEOC's customer service department with questions and use an out-of-state EEOC office when it is closer than an Ohio office.
- 5). Give the EEOC time to process and review your questionnaire. Be patient as it may take as long as 30 days to hear the EEOC's first response to your form. Provide prompt responses to any follow-up questionnaires or requests that you receive from the EEOC.
