What Happens During a Personal Bankruptcy?
- You will meet with an attorney to discuss your financial situation and personal bankruptcy types and to get advice. If qualified, the attorney collects information concerning each creditor including names, addresses, amounts owed and debt types. The attorney will also collect information about your assets, income and expenses.
- The attorney files the paperwork with the courts, and notifications are sent to your creditors. If you filed Chapter 7, you would receive a hearing notice and attend court. If you filed Chapter 13, you would attend the hearing and then make payments to the trustee, who would then pay creditors.
- After the Chapter 7 hearing, there will be a small wait, usually four months, after which you will receive your discharge notice in the mail. If you file for Chapter 13, you will keep making monthly payments until the final payment is made; you will then receive notification by mail that you are discharged.
