How do I Collect Interest on a Lump-Sum Judgment of Back Child Support?

    • 1). Read the court order. It will outline the amount of interest awarded and the time limitations. The interest on some judgments begins accumulating as soon as the judgment is ordered by the courts (or not long after) and stops when it is paid. Others only accumulate interest when it is apparent that the payer is refusing to pay the judgment.

    • 2). Contact your local child support enforcement agency. The agency helps collect the child support payments, including judgments, and will also collect the interest on the judgment. The agency takes the funds from the paying parent and gives them to the parent(s) who won the judgment. Installment payments on a judgment may also accumulate interest, which is added to the child support payment until the judgment is paid.

    • 3). Go to court. Once it becomes apparent that the paying parent is not going to meet the judgment, go back to the courts to not only seek other avenues for collecting the debt, but also to go on record with interest (or officially add the interest as a part of the judgment owed). This is done particularly when interest is not a part of the original order.

    • 4). Report all payments. The payer parent may want to make payments outside of the child support enforcement agency. Report these payments, because you may be entitled to the interest on the lump sum payment while the installments are being made. You cannot collect the interest if you have no proof of receiving the payments.
