An accident victim may properly pursue compensation from the individual(s) or company that caused their injury.
A common question asked by many accident victims is "how much is my case worth?"The answer to this question depends on a number of factors which this article will address in the following paragraphs.
MEDICAL EXPENSES Accident victims are entitled to compensation for their medical bills arising from medical care they received as a result of an accident.
This includes but is not limited to any and all bills for visits to an emergency room, bills related to physical therapy sessions, bills for any tests such as CAT Scans or X-Rays and the cost of any medication and/or equipment an injured individual may utilize.
Furthermore, an accident victim is entitled to compensation for future medical care that they will require.
Typically, a medical expert, such as a doctor, must assert that the injured party will require medical treatment into the future as a result of an accident.
The doctor will typically have to provide information as to the cost and frequency of any future medical care the injured party will require.
For example, I handled a case where an individual injured in an auto accident sustained a permanent injury to her back and neck.
My client's doctor concluded that she would require physical therapy for eight weeks of each and every year.
The doctor then provided the cost of such treatment.
Thereafter,we were able to calculate how much my client's future medical care would cost.
It should also be noted that an injured individual can properly be compensated for the cost of traveling to and from their healthcare providers.
LOST WAGES An accident victim is also entitled to compensation for any and all lost wages.
To be clear, lost wages refer to income which you were unable to earn due to your injury.
An accident victim can receive compensation for past and future lost wages.
The injured party will have to prove how much their income was prior to the accident they were involved in.
As to future lost wages, it will be necessary for the accident victim to provide evidence as to what their earnings would be in the future.
LOSS OF CONSORTIUM Accident victims are entitled to compensation for an injury to their marital relationship.
This is referred to as a claim for loss of consortium.
This injury to the marital relationship can be the inability of spouses to be intimate, the inability of spouses to communicate and/or the inability of spouses to carry on their marital relationship in the same manner they did prior to an accident.
HOUSEHOLD SERVICES There are times that an individual that has been injured in an accident becomes incapacitated and as a result must hire someone to care for them on a daily basis and/or maintain their household.
When this is occurs, the injured party is entitled to compensation for the cost of hiring someone to provide household services.
PAIN AND SUFFERING The term pain and suffering refers to compensation an injured party receives for:
  • Mental anguish and emotional distress;
  • Loss of enjoyment of life (inability to partake in physical activities such as sports and/or difficulty they experience in performing routine activities such as playing with their kids, walking, standing, sitting, etc.
    );
  • The physical pain they experience as a result of the accident they were involved in;
  • Permanent disability;
  • Disfigurement; and
  • Embarrassment.
PUNITIVE DAMAGES The purpose of punitive damages is to punish the defendant and deter others from conducting themselves like the defendant.
The defendant will typically be the person that caused an accident to occur.
Punitive damages are typically awarded where the defendant's conduct was outrageous.
For example, punitive damages are sometimes awarded where a defendant causes an auto accident while driving under the influence of alcohol.
In conclusion, there are number of factors that must be considered when determining the value of a personal injury case.
Further, an injured party must be able to provide evidence which supports the compensation they are seeking.
