How to Change Your Last Name With Immigration and Naturalization
- 1). Request a name change from the court while appearing during your naturalization ceremony. If granted, the new name will appear on your naturalization certificate which suffices as a court issued document. If you do not appear before the court, or this appearance is not applicable to your circumstances, then you must first obtain a legal name change and then request the update.
- 2). Make a photocopy of the official document that proves your name change. The copy must be clear, showing legible certification by the court or a government agency. The original may be requested later if the copy is not clear.
- 3). Complete form I-90 in black ink only if you have already received a green card. Attach the photocopy of your proof of name change to the form and enclose a check or money order for $365 made payable to the U.S. Department of Homeland Security in the mailing envelope. For an open petition, attach the photocopy to a letter indicating the reason for your name change and your request to update the petition on file. Include the receipt number from your I-797, Notice of Action, which was sent when the petition was received by the United States Citizenship and Immigration Services (USCIS). Evidence of the marriage and subsequent name change must be submitted in conjunction with the adjustment of status application when you have entered the U.S. with a K-3 fiance visa.
- 4). Mail the I-90 form to the USCIS Phoenix Lockbox Facility. The exact address used will be determined by the service you use to mail the package. An adjustment of status or petition update request must be mailed to the USCIS service center where the original petition was filed.
- 5). Wait for an I-797 indicating the information was received. It will be mailed to you. Your information will be updated with USCIS and all other branches of the immigration system. You will be notified once the update is complete. If requesting a new green card, the notification will indicate when you need to appear at your nearest Application Support Center for a new biometrics appointment.
