    Biological Parents

      Birth parents who are minors have the right to enter into an adoption agreement without the consent of their parents. Minor parents are considered emancipated for the purposes of adoption. Biological mothers can proceed with an adoption without the consent of the biological father if he has not established paternity or asserted his rights. However, a birth father who has not established paternity is entitled to notice of adoption proceedings if: 1) the child resided with him at any time during the 60 days immediately before the adoption placement or at any time since the child's birth if the child is less than 60 days old; 2) the father has repeatedly contributed to the support of the child and; and 3) initiated proceedings to assert his rights before the adoption. A birth father who has established paternity or rights has the right to work with the birth mother in selecting the adoptive family. A biological parent has the right to change his or her mind any time before he or she signs the Surrender, Release, and Consent to Adoption and Certificate of Irrevocability and the child is placed in the physical custody of the adoptive parent. Additionally, biological parents have the right to three adoption-related counseling sessions before surrendering the child and three sessions post surrender. The adoptive parents must pay all uninsured costs of these sessions.

      Adoptive parents are considered legal parents in Oregon and so have the same parental rights as biological parents. The adoptive parents are entitled to a copy of the complete medical history of the child and biological parents during the adoption process. They also have final decision-making authority in regard to contact with the birth family while the adoptive child is a minor. Adoptive parents can choose to arrange an Open Adoption Agreement, if the birth family agrees, in order to continue communication between the adoptive parents, the birth family, and child.

      Children 14 years or older have the right to consent to any Open Adoption Agreement. This agreement cannot be entered into without his or her consent to continue contact with the biological family. Furthermore, upon turning 18, an adoptive child has the right to use the voluntary adoption registry to identify his or her biological parents. The birth parents are given the option to voluntarily provide their information to the registry for future use by the child.
