Laws in South Carolina for Carrying Guns
- Certain weapons are illegal in South Carolina, even with the proper permits. They include machine guns, sawed-off shotguns or rifles, military firearms, defaced firearms and tear gas guns. Teflon-coated ammunition also is illegal. The laws regulating the transport and storing of such weapons are covered in South Carolina Code Section 16-23-210 (Article 3).
- Some people are not allowed to obtain a permit for, own or carry firearms in South Carolina. They include people convicted of violent crimes, members of any "subversive organization" and fugitives from justice. A court may restrict anyone who is mentally incompetent, an alcoholic or drug addict or anyone otherwise deemed unfit. No one under 21 may possess a weapon except in military service.
- To carry a gun, a person must not be a prohibited person and must have a gun license. To carry a concealed weapon, the person must have a permit. When a weapon is transported in a vehicle, it must be in a closed container or compartment. Guns may not be carried onto school property.
