How to Appeal a Long-Term Disability Decision

    • 1). Fill out an appeal request at ssa.gov. You will need to provide the Social Security Administration with all of your personal information and your attorney's information (if you have one). You will also be required to provide the reason your application for disability was initially denied.

    • 2). Fill out a disability report. The disability report should include the contact information for a witness who can verify your condition, any medical tests that verify the condition, when those tests occurred, and which doctors ordered them. If your medical condition has worsened since your rejection, you may include this in the disability report.

    • 3). Submit the forms to Social Security electronically.

    • 4). Wait for a response from the Social Security Administration regarding your Reconsideration request. This can take up to four months.

    • 5). Complete a Request for Hearing by Administrative Law Judge if a subsequent denial is issued. This form can be completed online and submitted electronically or printed out and mailed. A hearing with a judge will then be scheduled for you to present your case.

    • 6). Attend the hearing and explain the situation to the judge. Bring all supportive documentation and any evidence of your worsening condition, if applicable. The judge will make a decision based on your information and the disability guidelines.

    • 7). Have your attorney file a case against the Social Security Administration in your local District Court if the judge rejects your appeal.
