How to Fire Your Divorce Lawyer
- 1). Prepare a letter outlining your desire to terminate your divorce lawyer's services. You do not need to provide any reason for firing your attorney. Write something as simple as: "Please be advised that effective immediately, your services in my divorce case no longer are required. I am requesting that you provide me a complete copy of my case file immediately."
- 2). Deliver the letter to your divorce attorney's office either in person, or through certified mail with return receipt requested.
- 3). Schedule a specific time to pick up copies of all your records from your divorce attorney. Keep in mind that these records are your property. Although a divorce attorney can charge a reasonable fee to duplicate your file, she cannot deny you access to these materials.
- 4). Contact the local bar association if you encounter any problems firing your divorce attorney. The two most common problems are disputes over fees and problems obtaining records. The local bar association should maintain a committee designed to assist clients in either situation.
