    • 1). Gather all appropriate documentation that you will need to form a strong complaint. Bring anything that will prove your case, including pictures of property destruction if applicable, bank statements to show non-payment of rent, returned checks along with all written communication between yourself and the tenant. Try to secure the original documents as in some cases and jurisdictions photocopies may not be allowed. If your complaint includes destruction of property, you should also bring with you estimates for repairing the damage.

    • 2). Fill out your complaint in the courthouse district where your grievance with the tenant took place. In some counties, complaint forms are available online. Be sure to mention what you are suing for and the damages you wish to recover.

    • 3). File your complaint with the courthouse clerk. Make sure you include the full and correct name and address to ensure proper service. You will be provided with a court date. And the tenant will be allowed to answer your complaint within a certain number of days, though this may vary from state to state.

    • 4). Get prepared for your trial date and rehearse what you are going to say. You don't need to sound like you are reading something from paper, but you do need to feel comfortable making your case in front of the judge.

    • 5). Show up to trial and state your case providing all of the necessary documentation. This should include the original or certified copy of the deed, pictures, bank statements, etc. If you win, the judge will state how much is owed to you along with any other remedies.
