Hip Replacement Recipients Worldwide Oblivious To DePuy ASR Recall

25
As of last August of 2010, DePuy Orthopaedics, a subsidiary of pharmaceutical giant Johnson & Johnson, issued a monumental DePuy hip replacement recall of its metal-on-metal devices.  However, DePuy officials had no means of tracking hip replacement recipients worldwide and left the responsibility of informing these recipients to the orthopedists and surgeons who operated on them. With an estimated 93,000 hip replacements implanted in patients worldwide, it would be expected that the number of lawsuits would be almost equivalent.  Although the current number of lawsuits is only in the hundreds, the number is slowly rising. This clearly indicates that the majority of the thousands of hip replacement recipients around the world are still in the dark with regards to knowing about a recall.   Recipients of the ASR device often decide to address the issue by gaining the help of a legal counsel to help them recover the best lawsuit settlement possible.

The disparity in number of hip replacement recipients versus the number of lawsuits currently filed can be explained. It may be a simple matter in that many of the recipients may have just relocated without leaving any current contact information for their physicians.  This causes problems on many different levels. First, patients not experiencing any symptoms of hip implant failure or metallosis may not be seeking the proper medical care they need.  Secondly, the longer these patients wait to have their claim evaluated by a hip replacement lawyer, the less time they will have to file a claim against DePuy in a timely manner.

Recent studies producing sobering claims against the defective hip devices increases the urgency for recipients to seek a hip replacement lawyer posthaste. Australia and the United Kingdom are two countries that have regulatory artificial joint registries and initially reported that the metal-on-metal devices failed 12 to13 percent of the time after only five years. However, in the last several weeks, more ominous reports have shown that nearly 49 percent of these defective devices fail after only six years.  Consequently, a significant number of these recipients will need painful corrective surgeries that could easily have been prevented had DePuy taken responsibility in designing a better product and implementing a recall of its defective implants earlier.

All over the world, there are thousands of patients that still do not know about a DePuy hip replacement recall.  Recipients of hip replacements over the last several years need to determine if it was manufactured by DePuy. Once this has been confirmed, these patients should immediately consult with a hip replacement lawyer about getting compensation for damages they are entitled to.
