How to Attach Rental Income to a Judgment

    • 1). Obtain a writ of execution form from the clerk of the court. The writ of execution form requests that the court issue an order requiring certain income of the judgment debtor be paid to the judgment creditor. Explain within the writ of execution form, the source of the rental income and, if known, to which bank account the rental income is deposited. File the writ of execution with the clerk.

    • 2). Wait for the court to make a decision on the writ of execution. Eventually, the court will likely issue the writ of execution. Contact the local sheriff's office to determine the proper procedure to obtain the rental income. Explain that you have obtained a writ of execution. The sheriff may have you fill out an instruction sheet explaining what property must be seized. Send a copy of the writ of execution to the sheriff.

    • 3). Receive the rental income from the sheriff. The sheriff will serve the writ of execution on the bank that holds the rental income deposits. The bank will pay over the funds to the sheriff. The sheriff will then send a check to you. You will receive payments until your judgment is satisfied or the rental income ceases.
