How to Declare Bankruptcy in the U.K.
- 1). Visit your local County Court and request both the Bankruptcy Petition and State of Affairs forms, or visit the HM Courts Service Website and download the forms to print yourself. Complete the forms, giving details of your name, address and details of any arrangements you have made with your creditors. Make two additional copies of the forms as they need to be submitted in triplicate. Do not sign the petition form at this point.
- 2). Contact your local County Court and arrange an appointment. If you are currently receiving benefits, discuss whether you are eligible to have the court fee waived. If not, make arrangements to pay up to £600 for the court fee. This fee is due on the day you attend the Court for your bankruptcy hearing.
- 3). Attend the Court. Pay the court fee. The clerk will check over your documentation and witness your signature on the petition form. Await your turn to see the district judge, who will discuss your case with you and assess whether you are eligible for bankruptcy. If everything goes through correctly, the district judge will in many cases be able to declare you bankrupt the same day you attend court.
