How Do I File a Grievance with the Michigan Department of Labor Wage?
- 1). Ensure your grievance is legitimate. Read Michigan's Minimum Wage Act to understand Michigan's labor and wage laws. For example, you have a legitimate complaint if the employer pays you less than the minimum wage or fails to pay you back wages.
- 2). File a nonpayment of wages or fringe benefits claim within 12 months of the violation. If you didn't receive at least the state minimum wage or overtime pay, you can file the grievance up to three years after the violation.
- 3). Use the Wage and Hour Division's employment wage online complaint form if you're due wages or fringe benefits or if you did not receive at least the minimum wage or overtime pay. Attach supporting documents, such as invoices, statement of hours worked, employment contract, wage agreement or written fringe benefit policy (such as vacation or sick pay).
- 4). Download the employment wage complaint form from the Wage and Hour Division's website. Print and complete the form. Attach applicable supporting documents. File the wage claim in person or mail it to the Michigan Wage and Hour Division.
