How Do I File for Emancipation in Juvenile Court

    • 1). Determine the reason for emancipation. The judge can only grant emancipation if it is in your best interests. You must show that you are mature and able to financially take care of yourself. Simply because you do not get along with your parents or guardian is not a good enough reason for emancipation.

    • 2). Petition for emancipation in the juvenile court. Ask the court clerk to give you a form. Fill in the form with the reasons for your emancipation and file it with the appropriate filing fee.

    • 3). Attend the court hearing. The court will summon you for a hearing regarding your request. Be prepared to explain the reasons you want to be emancipated. The judge may also summon your parents or legal guardians to the hearing.

    • 4). Wait for the disposition of the court. The judge will issue an order in writing, if the jurist agrees to emancipate you. You may need to show a copy of the order when you engage in activities generally reserved for adults such as signing a lease, requesting a bank loan or getting married.
