How to Warn a Business That It is Being Closed Down
- 1). Write a notice explaining that the business is being closed down and jobs will be eliminated. The WARN Act requires that everyone at the business must be warned 60 days before the closing, to give individuals time to find other means of employment. The notice should include the closing date and explain why the business is being closed.
- 2). Give notice to all individuals connected to the business. All notices must be in writing, and failure to provide a written notice can lead to a civil penalty.
- 3). Show that the business closing was caused by circumstances that were not foreseeable in order to get a pass from giving the advance 60-day notice. This only happens in rare cases. When a foreseeable closure occurs, everyone must be warned 60 days in advance.
