How to File an Application for an Affidavit

    • 1). Call the courthouse. Speak to someone in the clerk's office and find out what information you'll need to provide in your application. The requirements might change from one jurisdiction to another, and they may also be different for criminal and civil cases. Typically you'll need a form of ID, and an application fee at the bare minimum. You should also know the case number, or at least the parties involved.

    • 2). Go to the courthouse. Some jurisdictions will allow you to fill out forms online, but generally speaking you have to be physically present at the courthouse in order to fill out your application for an affidavit.

    • 3). Fill out all the necessary forms. The clerk's office will explain what forms you need to fill out for the affidavit application, and one of the clerks will guide you as to what information you'll need to write down. Once the forms are complete, and all your information provided, all that's left is to pay the application fee, and your application for an affidavit will be filed with the court.
