How to Expunge a Juvenile Record

34
    • 1). Obtain an expungement form from the county clerk where you served your time or where your case was tried. Ask the county clerk if your state requires an accompanying copy of your criminal record report when you file your expungement petition. If so, order a copy of your criminal record report while at the county clerk's office, pay the filing fee and wait to receive your report in the mail.

    • 2). Complete the form detailing your name, date of birth, current address, telephone number, arrest date and Social Security number, if required. If the form requires your case number or additional information pertinent to your case, refer to your criminal record report for this information.

    • 3). Return the petition to your local county clerk's office along with your criminal record report, if required. Sign the form in the presence of the county clerk and pay the required filing fee. She will assign a case number and court date for your expungement hearing. Your state may require that you notify all agencies with custody of your records that you have filed an expungement petition and the subsequent date of your expungement hearing. Some courts, such as the Municipal Courts of Seattle, Washington, don't require an in-person hearing for expungement cases, unless the presiding judge requests a hearing.

    • 4). Arrive at your hearing on time on the assigned date. Answer the judge's questions honestly and respectfully; avoid interrupting while he speaks. If she decides to grant your expungement, she will send a certified copy of your expungement decision and a court order to all arresting agencies with your records in their possession to notify them to seal your juvenile record. Some courts, such as the Utah State Courts, will hold you responsible for paying and issuing copies of your expungement order to all arresting agencies with a copy of your record.
