Ann C. Logue a blogger from Chicago is being sued by hedge fund manager Keith Gilabert for a defamatory post she made on her website last year.
In a lawsuit being filed in Los Angeles Superior Court, Keith Gilabert as submitted evidence that Ann Logue intruded on his privacy and posted malicious lies because she had a posting about Keith Gilabert removed from another site. The posting dated November 18, 2011, €Keith Gilabert Pled Guity. That's a Fact,€ states that Gilabert raised $14 million, mass marketed the fund he managed and he charged a fee to his investors on phony profits. Logue concluded at the end of her blog that she is reporting €Facts€.
Gilabert, says in court documents that Logue is a liar and is trying to promote her failing and poor selling books by exaggerating and inventing scenarios that €simply do not exist€. Logue also stated that she cannot be sued for any content that she publishes on Gilabert since the statue of limitations has expired. Gilabert contends that the statue of limitations is on his side and that he has 1 year from the date of publication. €All I want is for Annie Logue to prove her facts in court, which I know she cannot because no government agency has ever submitted any evidence which will support her allegations,€ according to Gilabert.
Generally, when a post is removed from a site for defamation that would be the last you would expect to have heard from blogger Logue. But then blogger Logue posted another article, ironically stating that she did not want to pick a fight with Gilabert. €Bloggers didn't think they could be subject to libel,€ says, Eric Robinson, a Media Law Resource Center attorney, €You take what is on your mind, type it and post it.€
Robert Fox, Founder and President of Media Bloggers Association says, €People take advantage pf the anonymity to say things in public they would never say to anyone face-to-face€¦€
Gilabert adds, €Logue has stated that she reported facts, I have evidence that demonstrates her bad faith and negligence because she never tried to get both sides of the story. When someone is absolute, they are absolutely corrupt.€
Gilabert states, €I am holding blogger Ann Logue accountable for her actions. If she is going to print lies, I am going to make her pay in the court of law.€
The basic defense for libel is truth. If blogger Ann Logue cannot prove that her allegations that Gilabert charged fees on phony returns as truth, she will have a long and costly court case.
