How to Get a Criminal Record Expunged in Robeson County, North Carolina

    • 1). Obtain form AOC-CR-264, "Petition And Order Of Expunction," from the clerk of the Robeson County Superior Court (see Resources).

    • 2). Complete the form by printing clearly and legibly using only black ink. Sign the petition in black ink.

    • 3). Attach a personal affidavit stating that you have been on good behavior for a two-year period since the arrest if you are seeking to expunge a record off your arrest as a minor.

    • 4). Attach two affidavits from unrelated persons stating that you are a person of good character if you are seeking to expunge a record off your arrest as a minor.

    • 5). Attach a statement that the petition is a motion in the cause in the case in which you were convicted if you are seeking to expunge a record off your arrest as a minor.

    • 6). Attach affidavits from the clerk of superior court, the chief of police and, where appropriate, the sheriff of the county in which you were convicted and, if different, the sheriff of the county in which you live stating that you have not been convicted of any subsequent crime if you are seeking to expunge a record off your arrest as a minor.

    • 7). Attach a personal affidavit that you have no restitution orders or civil judgments against you if you are seeking to expunge a record off your arrest as a minor.

    • 8). Pay a fee of $125 if you are seeking to expunge a record off your arrest as a minor. There is no fee for other expungements.

    • 9). Determine when the AOC-CR-264 has been returned to the court clerk. You will not be notified, but it is your responsibility under the law to know.

      Ask the clerk or the district attorney to schedule a hearing on your petition.

      Attend the hearing on your petition. If the judge rules in your favor your criminal record will be expunged.
