How to Find Divorce Cases
- 1). Visit the clerk's office in the court system where the divorce was filed and the proceedings took place.
- 2). Ask the clerk to search the divorce cases. One of two things will happen. You will be allowed to search the records on your own or you will be asked to provide information about the case so a clerk or assistant can locate the information for you. Clerk's offices have their own procedures for how public information is handled, but as long as they make the information available to you they are operating in accordance with the law.
- 3). Fill out an information request form if asked. It may be a simple procedure or a more detailed Freedom of Information Act request form, depending on the circumstances.
- 4). Be prepared to wait if you're asking for records that are a few years old. By law, the court must respond to you within seven days, or with a response that explains why it's denying to provide the information.
- 5). Pay any copying fees. If you just want to browse the court record without making a copy, feel free to do so and make that known to the clerk.
