How to Do a Chapter 13 Dismissal
- 1). Compose a written notice stating your plan to dismiss your Chapter 13 bankruptcy case. Send the notice to the court trustee or court official who handles your case. Approval from him helps ensure a dismissal is granted by the court.
- 2). Locate the bankruptcy clerk's office in your area by using the Bankruptcy Court Directory (see Resources). Visit the bankruptcy clerk's office and obtain a form for Chapter 13 dismissal. This is a standard form kept in the office. The form is also available online at the U.S. Bankruptcy Court website (see Resources.)
- 3). Complete the form by following the instructions included. If you need assistance completing the form, contact the bankruptcy clerk's office. Include the reason you are requesting the dismissal. Also, provide a note stating your trustee's approval.
- 4). Provide your trustee with a copy of the Chapter 13 dismissal form. Also, mail a copy to the creditors included.
- 5). Get an objection deadline, or date for a creditor to object the dismissal, from the bankruptcy court. Each creditor receives the instructions regarding an objection from the clerk.
- 6). Receive the order of dismissal from the court if no creditors object and the trustee is in agreement. Attend the bankruptcy court hearing that grants the dismissal. Provide information regarding your request. Generally, the ruling to is set the day of the hearing and the dismissal is granted or denied.
