Motor Vehicle Insurance Requirements in Montana

57

    Minimums

    • Montana drivers must insure their vehicle with 25/50/10 auto liability insurance, which covers $25,000 in injuries if one person is injured at the hands of the policy-holder; $50,000 if more than one person is injured; and $10,000 to cover property damage.

    Documentation

    • If a Montana driver is in a vehicle accident, he must be able to show proof of auto insurance after the crash. He's also required to show proof any time he drives his vehicle, including if he's pulled over for a traffic citation. Auto insurance verification isn't mandatory at the time of vehicle registration.

    Penalties

    • In addition to first-offense fines and jail time, Montana drivers caught without auto insurance face five driver's license points for each incidence. Once a driver reaches 30 driver's license points, her license may be revoked by the state. Second offenses result in stiffer penalties, such as $350 in fines and 10 days of jail time, whereas third offenses lead to license revocation for 90 days.

    Uninsured/Underinsured Motorist Insurance

    • Montana is a tort state, which means that a driver may sue the at-fault driver after a vehicle accident. If a motorist is uninsured or underinsured, he's responsible for paying all damages, regardless of lack of insurance. For this reason, uninsured or underinsured motorist insurance, which covers the damages if another driver can't pay, isn't mandatory for drivers in the state.

    Car Rental Requirements

    • The car rental requirement for Montana drivers is equal to the liability auto insurance minimums. Usually available for an additional $10 to $14 a day, rental car companies provide this insurance if the driver's own policy doesn't cover car rental liability. Check with your auto liability policy first before adding on unnecessary car rental insurance.
